Q. - I am confused. I was told, when I moved to this
town, that the alley ways are for city and utility use only.
If so, why was my neighbor cited for the overgrowing
weeds in between their two homes? Why would the city not mow that, when
they mow the nearby parks?
How do I find the city ordinance that defines the
responsibilty of the homeowner and the alley?
Answer - I believe our ordinance regarding the maintenance
of easements and alleys is generally like those in most Texas Cities.
City Ordinance. No. 1532 passed in 1988 says:
"It shall be the duty and obligation of all owners, occupants,
and users of real property within a subdivision abutting upon public
utility easements in the city, at their own cost and expense, to maintain
and keep such easements adjoining their property free from accumulation
of unsanitary, unsightly conditions and tall grass and weeds as defined
in section 7-3 of this Code."
This is under
Building Regulations, section 4-16.1.
